BIZ Phone Card web sites are owned and operated by BIZ Phone Card. (BIZPC) Your access to BIZPC is subject to the terms and conditions of BIZPC, the Privacy Policy, notices, disclaimers and any other rules of use contained on this Web site. Your use of, and/or access to BIZPC constitutes your agreement to the terms and conditions stated herein.

BIZ membership

Only an individual may become a member of BIZPC. A member may only have one BIZ membership and that BIZ membership is not transferable. Any member found to have more than one BIZ membership will forfeit all benefits, including BIZ membership, and will be terminated immediately. A portion of or all of any refund, if applicable, may not be returned if you are terminated for having a duplicate BIZ membership. Registration for BIZ membership takes place on the BIZPC Web site. You will be asked to select a unique, inoffensive member ID that will be used to access your BIZPC account. This member ID will also be used to identify you to BIZPC and other members participating in the BIZPC plans. Once selected, this member ID cannot be changed. In addition, we require you to choose a password and password question with subsequent answer, so that we may identify you if you should ever lose or forget your password. Registrants must also provide certain personal information, as requested, during the registration process. BIZ membership and personal information will be collected and used in accordance with the BIZPC Privacy Policy.

You must not permit any other person to use your member ID and password to access your BIZPC account nor are you permitted to use any other person's member ID and password to gain entry into their account. You are responsible to keep your password secret and accept full responsibility for any person using your member ID and password. BIZPC is not liable for any loss or damage caused by any disclosure of your password or account.

You may not open an account for another person. To comply with the requirements of the Children's Online Privacy Protection Act (COPPA) children younger than age 18 will not be allowed to become members. Registration Information

You may, at any time, update your personal information by going to the Members Detail section in the Members Area. It is your responsibility to keep your e-mail and physical address current. Member accounts with incorrect or outdated e-mail addresses are subject to termination. BIZPC will use your e-mail address for verification of changes made to your account, policy changes and for sending our members periodical BIZPC updates.

Social Security Numbers

Citizens of The United States will be required to submit their Social Security when their BIZPC gross income has reached $600. This information is used for the purpose of reporting income earned to the correct taxing authorities. The BIZPC accounting staff will contact you when your income has reached the $600 point. Your BIZPC earning payments will cease until your Social Security number is received and verified by the BIZPC accounting office. Your Social Security Number cannot, and will not, be used for anything other than required tax reporting purposes.

Social Security Numbers will be verified through the Social Security Administration. Any member who purposefully sends a Social Security Number that is incorrect will be reported to the Social Security Administration and Internal Revenue Service for fraud and their BIZ membership will be terminated.

Retention of Member Information

You agree that BIZPC may retain your personal information for the duration of your BIZ membership with BIZPC and for a period of time thereafter

Referrals

As a member of BIZPC you will earn a ONE TIME fee of @ $50.00 on every referral who becomes a member. Referral fees are paid to you when the annual dues of your referral have been received.

BIZ membership Payments to BIZPC

Payments to BIZPC for BIZ membership are billed through the method you specify during registration. Declined, refused and/or returned payments will result in a $25.00 service charge payable immediately

Termination

As stated in our Privacy Policy, you are able to terminate your account at anytime. If terminating by your request, you will be eligible to receive all payments due to you. If BIZPC has terminated your BIZ membership for violations of any of our policies you will forfeit all monies earned as well as any referrals you may have acquired. You cannot "will" your BIZ membership to anyone. Your BIZ membership is transferable.

Re-enrollment

Once a member is terminated by his own discretion or by the discretion of BIZPC he/she will not be allowed back into the Program for a period of at least 3 months.

Fraud

Any member suspected of fraud, against BIZPC, will be immediately placed on suspension until further research is conducted. Acts of fraud include, but are not limited to: credit card fraud, entering incorrect personal information, re-entering the BIZPC Program after being terminated and any other violation of BIZPC Policies.

Our website may contain links to other companies and their websites. BIZPC is not responsible for, and makes no representations about, the privacy policies of such companies or the content of their Web site. You agree that BIZPC is not responsible for any relationship (damage or loss) you may have with a third party related to our websites.

Updates and Revisions

BIZPC reserves the right to change this or any policy with sufficient notice to our members. Continued BIZ membership in our program indicates your consent to the revised BIZ membership Agreement. If you do not agree with the changes, amendments or updates, you may request that your BIZ membership be terminated with BIZPC.

Compliance of Policy

You agree to abide by all BIZPC policies. You also agree to abide by all of your local, state, province, country or regional legal restrictions that may be applicable to your BIZ membership with the BIZPC Program. It is your responsibility to understand these laws and how they may affect or limit your BIZ membership with BIZPC. It is also your responsibility to file and make all payments relating to your income and the taxes due to your governmental authorities.

Limitation of Liability

BIZPC and its members will not be liable for any delay or failure in its performance under this BIZ membership agreement for causes beyond our control. Such causes include, but are not limited to: Computer hacking, system failures, Internet failure, acts of war, strikes or labor disputes. You agree and understand that in no event will officers or directors of BIZPC be liable for any direct, or indirect, punitive, incidental, special consequential and/or exemplary damages arising out of or in any way connected with the use of this Web site or one provided for you, with the inability to use this Web site or one provided for your use.

Exclusions and Limitations

Some jurisdictions do not allow the exclusion or certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some ofthe above limitation may not apply to you.

Indemnity

You agree to indemnify and hold harmless of BIZPC and its affiliates, officers, agents, or other partners, and employees from any third party claim or demand, including attorneys' fees, due or relating to your use of this website or one provide for your use, your violation of this BIZ membership Agreement, or content you submit to or post on the BIZPC website. You are responsible for any unauthorized use, loss or theft. Cards and pins are not refundable or exchangeable (ALL SALES ARE FINAL) unless defective. Neither card provider, network provider nor BIZPC make any warranty, expressed or implied, regarding the condition or fitness of the services offered for any particular use or purpose. The BIZPC liability shall be limited to: direct damages for personal or property injury, and for all other claims, an amount equal to the value of this Card. In no event will the BIZPC be liable for PUNITIVE, SPECIAL, INDIRECT, RELIANCE, INCIDENTAL OR CONSEQUENTIAL DAMAGES. The exclusive remedy for all disputes against BIZPC arising out of purchase or use of Card, except for matters taken to small claims court, is arbitration by a single arbitrator under the Consumer Arbitration Rules of the AAA. DISPUTES AGAINST BIZPC WILL NOT BE HEARD BY A JURY OR IN A COURT AND MAY NOT BE MADE PART OF A CLASS ACTION. Membership may be cancelled/suspended without notice if fraud isreasonably suspected.
